Terms & Conditions

These terms and conditions apply to all SOWND services (hereby referred to as "Services" or "Platform"), including the SOWND mobile application for iOS and Android devices and the web platform for venue management, created by SOWND (hereby referred to as "Service Provider") as a Freemium service.

Upon downloading, accessing, or utilizing the Services, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Services. Unauthorized copying, modification of the Services, any part of the Services, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Services, translate the Services into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Services remain the property of the Service Provider.

The Service Provider is dedicated to ensuring that the Services are as beneficial and efficient as possible. As such, they reserve the right to modify the Services or charge for their services at any time and for any reason. The Service Provider assures you that any charges for the Services will be clearly communicated to you.

User Accounts and Roles

SOWND operates as a two-sided platform connecting artists with venues. Different user types have access to different features and platforms:

Artist Accounts:

Artist accounts are primarily designed for use on the mobile application (iOS and Android). Artists can create profiles, upload EPK materials, manage their availability, submit booking requests to venues, and communicate with venue operators.

Venue Accounts:

Venue accounts are primarily designed for use on the web platform. Venue owners and managers can create venue profiles, manage calendars, review booking requests from artists, browse artist profiles, and communicate with artists.

Account Security:

It is your responsibility to maintain the security of your account credentials and access to the Services. For mobile users, the Service Provider strongly advises against jailbreaking or rooting your device, which involves removing software restrictions and limitations imposed by the official operating system. Such actions could expose your device to malware, viruses, malicious programs, compromise security features, and may result in the Services not functioning correctly or at all.

Booking Requests and Platform Facilitation

SOWND facilitates connections between artists and venues but is not a party to any agreements or contracts between users.

Booking Requests:

  • All booking requests made through the Platform are non-binding inquiries
  • Venues have sole discretion to accept or decline any booking request
  • Artists and venues are responsible for negotiating their own terms
  • Payment arrangements are made independently between artists and venues

SOWND is a facilitator only and bears no responsibility for the performance, payment, cancellation, or any other aspect of agreements made between artists and venues through the Platform.

Third-Party Services

Please note that the Services utilize third-party services that have their own Terms and Conditions. Below are the third-party service providers used by the Services:

  • Supabase
  • Google Analytics for Firebase
  • Firebase Crashlytics
  • RevenueCat

Service Availability and Limitations

Please be aware that the Service Provider does not assume responsibility for certain aspects. The Services require an active internet connection to function properly. The Service Provider cannot be held responsible if the Services do not function at full capacity due to lack of internet access or connectivity issues.

For Mobile App Users:

If you are using the mobile application outside of a Wi-Fi area, please be aware that your mobile network provider's agreement terms still apply. Consequently, you may incur charges from your mobile provider for data usage during the connection to the application, or other third-party charges. By using the application, you accept responsibility for any such charges, including roaming data charges if you use the application outside of your home territory (i.e., region or country) without disabling data roaming. If you are not the bill payer for the device on which you are using the application, they assume that you have obtained permission from the bill payer.

For Web Platform Users:

The web platform is designed to work with modern web browsers. The Service Provider recommends using the latest versions of Chrome, Firefox, Safari, or Edge for optimal performance. The Service Provider does not guarantee full functionality on outdated browsers or unsupported platforms.

The Service Provider cannot always assume responsibility for your usage of the Services. It is your responsibility to ensure proper access to the Services, including maintaining appropriate internet connectivity and compatible devices or browsers.

Service Provider Responsibility

In terms of the Service Provider's responsibility for your use of the Services, it is important to note that while they strive to ensure that the Services are updated and accurate at all times, they do rely on third parties to provide information to them so that they can make it available to you. The Service Provider accepts no liability for any loss, direct or indirect, that you experience as a result of relying entirely on this functionality of the Services.

Platform Updates

The Service Provider may update the Services at any time. For the mobile application, updates may be required to maintain compatibility with your operating system. You will need to download mobile app updates if you want to continue using the application. The web platform may be updated without notice, and changes will be reflected automatically when you access the platform.

The Service Provider does not guarantee that they will always update the Services so that they are relevant to you and/or compatible with the particular operating system version or browser installed on your device. However, you agree to always accept updates to the mobile application when offered to you.

The Service Provider may also wish to cease providing the Services and may terminate their use at any time without providing termination notice to you. Unless they inform you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must cease using the Services, and (if necessary) delete the mobile application from your device.

Changes to These Terms and Conditions

The Service Provider may periodically update their Terms and Conditions. Therefore, you are advised to review this page regularly for any changes. The Service Provider will notify you of any changes by posting the new Terms and Conditions on this page.
